Bahrain labour court: what happens after a complaint?

For a private-sector labour claim in Bahrain, start with a written statement to the Labour Case Management Office. A judge looks at the case and tries to help both sides reach an agreement. If that fails, the High Civil Court decides the dispute. This law does not cover government employees under civil, military or special service rules.

Domestic workers and family members supported by their employer need to check the scope too. Much of the law excludes them, but its chapter on individual labour disputes still applies. Take the papers that support your claim to the first meeting.

Start with a written claim

Once you send in the statement, the office gives you proof that it registered your case and a date to meet the judge. The other side gets a copy of your claim and the meeting date.

At that meeting, you or someone representing you must show the papers behind your claim. If you want witnesses, identify what each will help prove and provide their names and addresses. The other side must answer with its documents and evidence. The judge sets the deadlines.

Why is there another chance to settle?

You may already have tried to resolve the dispute through the Ministry of Labour. Its individual dispute body can attempt a settlement before court if both sides agree. When you file a court claim, the case goes to the Ministry of Justice's preparation office. You still have a chance to settle there.

The judge has now seen both sides' accounts and evidence. That matters: the settlement proposal comes after the judge has studied the dispute. Before the last meeting, the judge writes a report and offers a settlement. If both sides agree, they sign the settlement record with the judge. That signed record can be enforced. If they cannot agree, the judge sends the case to the High Civil Court.

A court case is not a promise of payment or a win. The court hears the dispute and gives a judgment. A judgment can be challenged at the Court of Cassation under that court's rules.

Can LMRA help an expatriate worker?

For an expatriate worker, LMRA can help with the filing paperwork. Its Protection and Grievances Centre has a Labour Suit Coordination service. The service page lists a coordination form and asks the worker to visit the centre. LMRA says the centre prepares the suit file, translates supporting documents and submits the lawsuit. It follows the case until the dispute is resolved.

What does the public court portal show?

Bahrain's Courts and Cases Services page groups services from the Ministry of Justice. It says the court case services are available only in Arabic. A separate request-status page covers applications submitted in civil or court cases.

Workers' labour claims are exempt from court fees under the Labour Law. The same provision says a court may order a claimant to pay some or all costs if the claim is rejected.

Frequently asked questions

Does this route apply to government and domestic workers?

Government employees under civil, military or special service rules are outside this law. Domestic workers and family members supported by their employer are generally excluded too. The chapter on individual labour disputes still applies to domestic workers and supported family members.

Does a labour complaint automatically become a court case?

A court case starts with its own written claim. The law describes a voluntary settlement body before court, then a separate written claim filed with the Labour Case Management Office.

Where does an individual labour claim go first?

It starts at the Labour Case Management Office in the Ministry of Justice. The office registers the written claim and gives the claimant a meeting date with the case management judge.

What happens if the case does not settle?

If there is no settlement at the end of preparation, the judge sends the case to the High Civil Court. The court then hears the case and gives a judgment.

Do workers pay a court filing fee?

The Labour Law exempts claims brought by workers or their beneficiaries from court fees. If the court rejects a claim, it may order the claimant to pay some or all costs.
