What to review after a Bahrain divorce petition is rejected

By Gaurav Agarwal · Updated 14 October 2026

A husband's refusal does not end a wife's Sunni divorce case. She may review divorce for harm under Article 98, the Article 99 to 103 arbitrator sequence if harm was not proved, or judge-ordered khul under Article 95(1)(b) when his refusal is obstinate and there is fear they will not keep God's limits, for consideration capped at the dowry. Husbands should ask a Bahrain-licensed lawyer.

01Start with the legal route in the judgment

Do not prepare a third petition from memory. Put the latest judgment, the original statement of claim and every filed exhibit side by side. Bahrain's Family Law recognises court-ordered separation as a statutory way a marriage may end. The issue is whether the facts and proof fit the route that was actually pleaded.

This guide focuses on Sunni Family Law routes available to a wife. Bahrain's issuing Law No. 19 of 2017 applies the Family Law to Sharia-court disputes involving Sunni or Jaafari jurisprudence under Article 4 of the issuing law. Article 5 of that issuing law sets the sequence for identifying the applicable jurisprudence when a marriage contract was concluded abroad. A husband whose wife refuses divorce needs separate advice on the route available from his judgment and marriage record.

This is an independent guide to official sources, not legal advice. Only the judgment and complete case file can show why a particular petition failed.

The complaint is failure to maintainNon-maintenance under Article 106Was ability, refusal, visible property or claimed insolvency proved?
The judgment used a different routeAppeal or procedural requestWhat exact legal or factual finding must be challenged?

02Turn the rejection into a one-page issue list

Read the operative part and reasons, not only the word rejected. Mark each finding under one of four headings: wrong route, fact not proved, document or witness not accepted, or procedure not completed. Then attach a page reference from the judgment to every heading.

In a Sunni harm claim, Article 98 gives the wife a right to seek divorce for harm that makes continued married life impossible. The judge must attempt reconciliation, and if reconciliation fails and harm is proved, the judge orders divorce. A petition can therefore fail because the court did not find the required harm proved, even when the relationship has broken down.

If the court said harm was not proved, ask whether Article 99 became relevant. That article addresses continuing discord when reconciliation is impossible and directs the judge to appoint two arbitrators. This is a separate procedural question from simply repeating the same allegations.

  1. Obtain the complete written judgment, including reasons and the date you were notified.
  2. Print the last statement of claim and any later amendment to the requests.
  3. Create a list of every allegation, with the exhibit or witness relied on for it.
  4. Highlight each factual finding the court accepted and each one it rejected.
  5. Write down the exact relief requested and the route cited for that relief.
  6. Ask counsel to identify the next valid procedure and its deadline from the case record.

03Build an evidence map before the lawyer meeting

Organise proof by allegation, date and source. For each event, record who saw it, which original document exists, where it was filed and how it supports the legal test. Avoid sending a lawyer a single folder of unsorted screenshots.

Article 140 accepts competent testimony from relatives or persons connected to the party for whom they testify. It also treats evidence that gives knowledge of harm as relevant to proving harm. The lawyer still needs to assess admissibility, weight, authenticity and whether each item was properly filed.

Keep original files, full message threads and unedited exports. Add short translations for planning, then ask whether certified translation is required for filing. Do not crop away dates, account identifiers or surrounding messages that affect meaning.

04Review the arbitrator stage if discord continues

When harm is not proved but discord continues and reconciliation is impossible, Article 99 directs the judge to appoint two arbitrators, preferably from the families when possible or otherwise people able to reconcile the spouses or specialists. The arbitrators investigate the causes of discord and try to reconcile the spouses.

Their report should describe their efforts and proposals, including the extent of fault attributed to either spouse. The report is due within no more than three months from appointment. The judge may extend that period on a joint request from the arbitrators or to achieve a compelling interest.

After the report, the judge may approve it or, by reasoned decision, appoint others with expertise in psychological and social matters to arbitrate again under the same procedures. If the arbitrators disagree, the judge appoints others or adds a third, tie-breaking arbitrator with relevant expertise. If reconciliation remains impossible and discord continues, Article 103 says the judge orders divorce based on the arbitrators' report.

Five questions about the arbitrator record

Who was appointed, and on what date? Was each spouse heard? What documents were provided? Did the report explain reconciliation efforts and fault? Did the judgment accept, reject or replace the report?

05Use the official court route for the next filing

The Bahrain portal provides Arabic-only services to submit a court case, attach the claim statement and supporting documents, and pay assessed fees. The registration service lists a process time of 7 working days. This is a service-processing estimate, not a filing deadline.

The applicant must pay the full assessed fees unless an exemption or postponement request applies. The portal also lists Arabic-only services to calculate court-case fees, view notifications, enquire about a case and submit an expert report. Check the notification date shown in the case record before a Bahrain-licensed lawyer calculates any deadline.

For an existing case, the National Portal also lists Arabic-only requests and case-note services. Ask whether the next step belongs in the current case, an appeal, a reconsideration route or a new claim. Do not choose based only on a menu label.

  1. Open the official Courts and Cases Services page.
  2. Select the service identified by your lawyer for this judgment and stage.
  3. Enter parties and case details exactly as they appear in the court record.
  4. Attach the final pleading, indexed exhibits and any required translation.
  5. Review the assessed fee and any exemption or postponement route before paying.
  6. Save the submission receipt, request number and payment record.

06Ask about temporary orders and immediate needs

A divorce case can continue while urgent family needs remain. Article 114 allows the judge to issue interim measures for the spouse's and children's maintenance, custody and visitation while the divorce claim is being heard. Bring current expense records, child arrangements and any existing order so counsel can assess whether a temporary request is appropriate.

In a Sunni non-maintenance case, Article 106 contains its own sequence. A husband who proves insolvency, or falls within the other stated circumstances, may receive at least one month and no more than three months to pay before divorce is ordered. Match the allegation and evidence to the correct route.

Preserve safe copies of records and ask a Bahrain-licensed lawyer about any urgent protective procedure shown by the case facts.

07Take these questions to the lawyer

Use the meeting with a Bahrain-licensed lawyer to obtain a written route and evidence plan. Ask for the conclusion in plain language, the next filing, the deadline calculated from the case record, the documents still missing and the realistic consequence if the evidence remains unchanged.

The official pages do not diagnose an individual rejection, state one fee for every family case or supply a universal appeal deadline. Those points depend on the judgment, notification date, service chosen and applicable procedure.

  1. Which legal route did the latest petition actually plead?
  2. Which element did the court say was not proved?
  3. Can any missing evidence be introduced at the next procedural stage?
  4. Should the arbitration sequence have applied after unproved harm?
  5. Is the next step a request, note, appeal, reconsideration or new claim?
  6. What deadline runs from the judgment or notification date?
  7. Are interim maintenance, custody or visitation measures needed?
  8. What are the assessed court fee and likely professional fees?

08FAQs

Can a husband block his wife from every Sunni divorce route by refusing?

No. Refusal alone does not end the wife's case. Depending on the facts, she may review Article 98 harm, Article 99 to 103 arbitration after unproved harm, or judge-ordered khul under Article 95(1)(b) when the husband's refusal is obstinate and there is fear the spouses will not keep God's limits, for suitable consideration capped at the dowry.

What if the court says harm was not proved?

If discord continues and reconciliation is impossible, Article 99 directs the judge to appoint two arbitrators. Ask whether that stage applied in your case.

How long do the arbitrators have?

Their report is due within no more than three months from appointment. The judge may extend the period on a joint request from the arbitrators or to achieve a compelling interest.

Can relatives testify about harm?

Article 140 accepts testimony from a relative or connected person who is competent to testify. The court still evaluates the evidence.

Can I file the next document online?

Yes. Bahrain lists Arabic-only services for filing a case, requests, notes, notifications, fee calculation, expert reports and enquiries. The correct service depends on the judgment and stage.

Is there one fixed fee for another petition?

The official service requires payment of assessed fees, but it does not state one universal fee for every family case. Check the service calculation for your route.

Can the court make temporary child or maintenance orders?

Article 114 allows interim measures for maintenance, custody and visitation while the divorce claim is pending.

Should I file the same petition again with more detail?

First have counsel compare the judgment, pleading and evidence. Repeating the same route without curing the court's stated finding can reproduce the same problem.
