02Confirm that the Property Lease Law applies

The official SLRB current law page publishes Law No. 27 of 2014 with amendments. Article 2 applies it to property prepared for residential, industrial, commercial, professional, craft and other uses, then lists exclusions. These include agricultural land, hotel and tourist property, certain industrial property, employer-provided housing and furnished flats whose rental period does not exceed one month.

Write down the use, term, property type and occupancy arrangement before relying on a residential rule. A yearly flat, a one-month furnished stay, an employee accommodation arrangement and a commercial office can produce different answers.

03Use a written, registered lease

Article 3 requires covered leases and amendments to be written and registered within one month. The official Lease Contract Registration service provides the government route, while Lease Contract Enquiry lets users check the record.

Article 7 places the residential registration cost on the landlord. If the landlord refuses after registered notice, the article provides a tenant route to register and deduct the fee from rent. 04Separate rent, advance payment and security

Article 19 of the official English law text distinguishes advance rent from security. For residential property, the cash advance is capped at three months under the default text. The security amount is capped at one month’s rent and is to be returned at the end or on handover, subject to tenant obligations deducted from it.

Record each payment separately: purpose, amount, payer, recipient, date, payment method and receipt. The lease should also allocate EWA, cooling, internet, common services, municipality treatment, parking and maintenance. Article 26 places utilities, shared services and tenant maintenance on the tenant unless the parties agree otherwise.

05Classify a repair before arguing about payment

The law distinguishes necessary maintenance, normally associated with preserving the premises and keeping it fit for use, from simpler tenant maintenance. Article 9 requires delivery in a usable condition, and Article 11 addresses necessary maintenance and loss of use. Article 26 addresses tenant maintenance and service charges, subject to the written agreement.

06Apply the default rent-increase rule carefully

Article 27 says the default rule prevents an increase until two years from the lease start or the last increase, whichever is nearer in the official English text. It sets 5% for residential use and 7% for commercial, industrial, professional, craft or other use, with a maximum of five increases during the contractual relationship. It also requires registered notice stating the proposed increase at least three months before the second year ends.

The article expressly allows a different written agreement. Read the lease before treating the statutory default as an absolute cap. Save the notice envelope or delivery proof, the earlier rent record and every written amendment.

07Separate renewal, expiry and eviction

Renewal asks whether the tenancy continues. Expiry asks what the contract says happens at its end. Eviction is a legal claim for possession on a stated basis. These events can overlap, but they are not interchangeable.

Article 35 contains minimum-period and renewal provisions for covered leases, subject to written agreement, and Article 38 lists grounds on which a landlord may request eviction. Check the term, notice method, delivery date, arrears record, use of the premises, subletting and the stated ground. Never rely on a verbal description of the notice.
