Bahrain Lease Agreement: Clauses, Registration and Tenant Checks

A Bahrain residential lease should identify the property, parties, money, services, repairs and exit in precise terms. For a covered lease, register it through the official service within the statutory period and keep the validity record.

01What the lease-agreement SERP leaves fragmented
The top results for “lease agreement Bahrain” were the official Lease Contract Enquiry service, a municipal customer-service page and a private reproduction of the Property Rent Law when checked in Bahrain. The official pages are essential for the service and law, but a renter or landlord still needs one drafting and evidence checklist from authority and property details through registration, utilities, repairs, renewal and handover.

02Check whether the Property Lease Law applies
The official Property Lease Law, Law No. 27 of 2014 covers property intended for accommodation and other listed purposes, subject to its terms and exclusions. Article 2 excludes several categories, including furnished flats with a maximum lease period of one month.
Do not decide scope from a marketing label. Record whether the unit is residential, furnished, short stay, employer-provided, government-owned or part of another excluded category, then obtain advice when the position is unclear. 03Identify the property and every authorised party
State the exact block, road, building, floor and unit. Match the property to the owner or authorised lessor and identify every adult occupant where appropriate. If an agent signs or receives money, attach or reference the authority that connects the agent to the owner.
If a broker or sales agent is involved, use the official RERA accredited-licence service. Match the person, firm and role to the transaction. The lease signer, payment recipient and receipt issuer should form one documented chain.
State the permitted use, occupancy, parking and included areas. A storage cage, parking bay, balcony, furniture package or facility access that affected the decision belongs in the document or annex.
04Separate every payment line
State the rent, due date, method, payee, receipt process and any late-payment consequence allowed by the agreement and law. Separate advance rent, security amount, agency charge, utility deposit, access-card deposit and other payments.
Article 19 of the official lease law limits cash advance for covered residential property to three months’ rent and the security amount to one month’s rent. 05Define EWA, cooling, internet and municipality treatment
The official EWA Open Account Service is for opening electricity and water service at existing premises. The lease should state whether the tenant opens an account or the owner keeps it, together with the starting reading and account responsibility.
If a service is included, name it. State the cap, billing period, bill evidence and excess formula. Separate EWA from district or building cooling, internet, gas, parking, facilities, cleaning and maintenance. “All inclusive” without these details is not an operating rule.
The government Address Certificate service lists documents and municipality treatment for its stated situation. Check the current service and make the lease address and utility wording consistent with the actual arrangement.
06Turn repair duties into a working system
Article 10 of the official law addresses necessary maintenance by the lessor after notice. Articles 25 and 26 address the lessee’s care, rental maintenance and utility costs. A useful lease converts those legal starting points into a reporting and access process for the actual property.
List the maintenance channel, emergency contact, response target, entry notice and approval process. Identify routine care, necessary repair and responsibility for supplied appliances, cooling, plumbing, electrical work, pool, garden and common systems where relevant.
Attach a signed inventory and condition report. Photograph every room, supplied item, meter and existing defect. Record the keys, cards and remotes. This evidence gives both parties a baseline for repairs and deposit reconciliation.

07Register the covered lease and verify it
Article 3 of the official law requires a written lease and registration within one month for covered property. Article 7 says the lessor bears the registration fee and sets a residential range of BD1 to BD15. It also provides a route for the lessee to register after giving notice when the lessor refuses.
Article 8 says the Rent Disputes Committee will not accept disputes arising from unregistered lease agreements. Use the official Bahrain.bh Lease Contract Registration service and read its current identity, contract and property requirements.

07ADo not use “Ejari” as the service name
Bahrain’s official service is Lease Contract Registration through Bahrain.bh. “Ejari” is commonly associated with another country’s system and can lead a renter to the wrong website or checklist. Use the Bahrain service name, current requirements and official domain.
If a landlord, agent or form uses an informal label, ask for the official registration record and verify it through the Bahrain enquiry service. The evidence is the government record, not the nickname.
08Write renewal, rent change and exit before signing
State the term, renewal method, notice period, delivery channel and consequences of staying after expiry. Article 27 of the official law sets the covered residential timing, 5% rate, three-month notice and written-agreement rules for rent increases. Read the current text and make the lease clear.
Article 29 requires written lessor permission for assignment or subletting. Add guest, occupancy and subletting terms that match the intended use. Do not rely on silence if a room or whole-unit sublease may be needed.
For move-out, define cleaning, inspection, meter readings, utility closure, key return, deposit calculation and timing. Repeat the condition report, return items against a signed list and request a written, itemised reconciliation.
