Off-Plan Property in Bahrain: RERA, Escrow and Developer Checks

Verify four things before paying: the developer licence, the project licence, the unit and contract record, and the project escrow route. Repeat the check before every construction-linked payment.

01What the top three results miss
The current results were the Real Estate Regulatory Law, RERA’s off-plan buyer guide and a copy of the same law. The official coverage is strong, but the legal text and buyer factsheet do not provide one compact transaction file.

02Verify developer and project separately
RERA’s official off-plan buyer guide says the developer and the off-plan development must be licensed before a binding contract. Use the official RERA services directory and accredited-licence service to match the legal names and licence details.
A licensed developer does not automatically prove that every project, building, phase or unit is licensed. Record the project identity, parcel, phase and unit exactly as shown in the official and contract records.
03Use the disclosure period
The RERA guide describes documents buyers should receive before signing, including project, unit, contract and owners-association information. Read the complete set and record missing or inconsistent details.
Match the advertised area, view, parking, fit-out, completion date, common facilities and service-charge projection to the draft agreement. Marketing language should not replace contract terms.

04Map the sales agreement
Build a table of price, reservation amount, deposit, milestones, completion, grace periods, specifications, area adjustment, handover conditions, defects, assignment, cancellation and dispute terms. Record which document controls if brochures conflict.
The official Real Estate Regulatory Law governs licensing, registration, escrow and off-plan project controls. The official law PDF is useful for a saved transaction file.
05Pay only through the project escrow route
Article 24 requires a separate escrow account for each off-plan project. Article 25 restricts that account to constructing, executing and managing the project and protects it from unrelated developer creditors, subject to the law.
Match the written escrow instruction, project name, account holder and bank details. Verify changes independently through official contact details. Do not transfer to a personal or unrelated account because a message says the project account changed.

06Match progress payments to approval
RERA’s buyer guide says that before each progress payment, the developer should provide the RERA approval for the next payment. Match the approval to the project, milestone, unit, amount and contract schedule.
Keep the payment request, approval, bank instruction, receipt, escrow statement if provided and updated balance. A construction photograph alone is not the stated regulatory approval.
07Inspect completion and title steps
The RERA guide explains final municipal approval, utilities, title deeds, final payment and the owners-association process. Inspect the finished unit against the contract and schedule defects with photographs and dates.
Confirm completion documents, title status, service charges, common areas, parking, keys, meters and handover conditions before releasing any final amount required under the transaction.
08If the project or payment does not match
Pause further payment, preserve the official search, advertisement, disclosure, contract, escrow instructions, approvals, receipts and correspondence. Write a short chronology and ask for the mismatch to be corrected in writing.
